Service Quality Guidelines for Contractor Agencies

Contractor Agency Warranties and Representations

Contractor Agency (CONTRACTOR) is responsible for all costs and fees associated with ensuring compliance with the Independent Contractor Agreement (AGREEMENT) which includes these Services Quality Guidelines for Contractor Agencies by reference and ensuring and maintaining compliance of all its employees, agents and representatives who perform services on behalf of MASTERWORD as outlined in the AGREEMENT.

CONTRACTOR will promptly remove any personnel from performing Services, if, in MASTERWORD’s sole discretion, the performance or conduct of such personnel is inappropriate, unsatisfactory or detrimental.  Upon request, CONTRACTOR will secure alternative qualified personnel to perform Services.

Regulatory Compliance

All Services have been or will be provided by CONTRACTOR to MASTERWORD, in compliance with all applicable laws and regulations.

Debarment, Suspension, and Other Responsibility Matters

CONTRACTOR warrants neither it nor its employees, agents, officers, directors, or contractors have ever been debarred, suspended, declared ineligible, or voluntarily excluded from a federal or state health care program, including, but not limited to, the Medicare and Medicaid programs, and further agrees CONTRACTOR will not knowingly perform any act that would cause such exclusion during the term of the AGREEMENT and that CONTRACTOR agrees to notify MASTERWORD immediately if it or its employees, agents, officers, directors, or contractors become debarred, excluded, suspended, ineligible or voluntarily excluded from these programs during the term of the AGREEMENT.

Employment Screening & Background Checks

Prior to providing services, CONTRACTOR will ensure that CONTRACTOR’s personnel who provide Services under the AGREEMENT are screened for:

  • In-country criminal records search for the most recent 5 years,
  • Educational background verification, and
  • Employment history verification.

CONTRACTOR will promptly provide MASTERWORD with documentation of competency assessments for CONTRACTOR’s personnel within 48 hours of MASTERWORD’s written request.

Record Retention

CONTRACTOR agrees to retain all records, supporting documents, and any documents pertinent to the AGREEMENT until five (5) years after: 1) termination of the AGREEMENT, or; 2) until any audits in progress at end of five (5) year period are complete, whichever is later.
